Murder In the Second Degree
Posted by Kevin on July 10th, 2007 filed in libertyThe official arraignment was held today and the charges have been bumped up to murder in the second degree!
In my humble opinion (and I am a lawyer), this was definitely murder and not manslaughter.
What does this mean? Instead of looking at a maximum 6/7 year sentence, Mr. Aguirre is now looking at a minimum of 15. Of course, there is still a chance to plea down the charges but I have every confidence that the DA is working hard for justice.

Right now the others have not been charged, but I would not rule out that some of them may face some charges eventually, I think the police are likely still working on that end. I think there is quite a possibility that there may be a plea bargain in Aguirre’s case, but nonetheless, upping the charges to the level they should be is a good thing.

i’m just a civil lawyer but i wholeheartedly agree with kevin…great news…was wondering what was holding them back…good for the DA!!
