What about the passengers who were at the scene of the crime?
Posted by Jake on July 12th, 2007 filed in libertyI am very frustrated that not one of the passengers have faced any charges thus far. If they are so innocent, why did they all wait multiple days to talk to the police? Yes, that’s right, multiple days. Liberty was killed Saturday at 2:00 am. The passengers, and of course Erik Aguirre, waited all of Saturday, all of Sunday, all of Monday, and all of Tuesday even into Wednesday and did nothing to support our cause in seeking justice for Liberty. Hardly the actions of “good people” as Aguirre’s defense attorney has so amply proclaimed Erik Aguirre to be. At the very least, these 3 other passengers in the car that dragged Liberty 70 feet to his death (one of whom is Aguirre’s alleged 18 year old girlfriend) should sincerely apologize to Liberty’s family and friends for prolonging our suffering for not doing the right thing and immediately calling the police and turning in the suspect. Have we received any sort of an apology or sympathy from them? Absolutely not. Instead we have recieved multiple rude, callous, and cold messages from people coming on this site defending the passengers and even having the nerve to call us disrespectful. Most of them were so disrespectuful and callous that we decided to remove them. These actions are shameful and disgusting and do not buttress the claim that these are good people. For these people to come onto our memorial website, that was originally set up to catch Liberty’s killer precisely because they did not do the right thing and call the police when they immediately got home, is reprehensible. We too wish this website was not necessary, more than you will ever know. Liberty was killed in a horrible and violent fashion. The days after watching Liberty murdered in front of my eyes were the worst in my life, and no doubt Liberty’s family’s lives; it is a travesty that our misery was prolonged because people would not do the right thing and turn in the suspect. Perhaps if these people cannot be dealt with criminally, they may be held liable through civil action.
For Liberty,
Jake

Good for you Jake. Have you spoken with the DA’s office regarding this? They should be charged as accessories to murder.

Jake,
Fanatstic work you have done with this site. I knew Liberty ealry on through elementary and junior high. We lost touch after that but our families remain quite close. A truly terrible tragedy…
I was just curious if you had an information regarding the background of Erik Aguire. Does he come from a troubled past (criminal or not)?

The question for me is whether the “Go, Go, Go!” shouted by a passenger actually resulted in a further perpetration of the crimes. Also, did they help Aguirre flee to Mexico, cut and dye his hair, buy a new bumper or scrub down his car?
We know the girl was at the police station the night they found Aguirre. She turned herself in the next day.
There is no doubt in my mind that she only “came forward” after she had already been identified.

I find it extremely disheartening to hear that people would come on this site to do that. It saddens me that some people are so inconsiderate and blind to the needs of others sometimes..
Anyone can make a million excuses for not taking responsibility for their actions. It’s so disgusting that she would yell “go go go.” I wouldn’t have a problem knowing that she has troubles sleeping at night…but that would require her to actually have a soul and I honestly wonder about people sometimes…

I have not seen anything in the news about this. You’d think at the least that these people would feel torn up and be issuing apologies left and right based on the horror of the situation and the shame of the actions. Even if it was not from the right motive of truly offering a heartfelt apology based upon contrition, you’d think they’d at least apologize for the sake of developing a positive image and maybe a lesser sentence.
I think Kevin brings up good points. What does “go go go” imply?
A question though on Kevin’s thoughts: “Also, did they help Aguirre flee to Mexico, cut and dye his hair, buy a new bumper or scrub down his car?”
Did any of that happen or are you just posing hypotheticals? I didn’t read anything like that. Let me know.
Good job on the site. I only met Liberty a couple of times and didn’t know him and I feel sad. I can’t imagine how such close friends and family feel then.

This is a website meant to honor a fallen friend and brother. It was also designed to find the cowardly dregs responsible for the horrors that occurred. Why sully this memoriam with outrageous claims of a killers supposed good side. I come to this site everyday to catch up on updates with the case and to read great stories from people who crossed paths with Liberty. If anybody has the need to be vile and defend the murderer or try and debate other peoples memories of Dirt, go somewhere else. Save the slanderous statements and foolish comments you’re little internet blogs. But if you knew the great man who we lost violently and tragically, then please by all means keep posting the great tales of Liberty X. Jaswal.

Ryan, all of that happened.

without knowing more, i assume there was some plea of sorts with the passengers who “came forward” or corroborated the evidence to charge the killer?…but yeah the “go go go” sounds awfully incriminating…at the very least an independent act to support SOME accomplice charge wouldn’t you think kevin? either way it is outrageous and beyond f-ed up that the passengers/their friends are trying to defend such themselves, rather than apologizing profusely for their horrible and unjustifiable actions.

I didn’t know that people were coming on to this site to defend Liberty’s killer & the passengers. That is so appalling to me that I can’t even express it in words. It’s beyond disrespectful, it’s beyond rude, it’s just plain heartless. I hope these people get some decency and stop posting such messages. What Erik Aguirre did was WRONG. Wrong is an understatement. What the passengers did was wrong. I don’t see how anybody in their right mind could come to this site to defend these people’s actions.
Also, I didn’t know Aguirre cut & died his hair, and attempted to clean the evidence off his car. “Good kid” indeed.

what these people did was awful. i know a lot. i do not defend one thing. the sorrow expressed by so many and their families towards the victom’s family is sincere, but they are not allowed to express it yet, because of legal advice. i know the driver and passengers and they do feel great sympathy towards the jaswal’s.the only reason i’m passing this info on is because i do not want liberty’s parents to believe that people don’t feel really sad about all of this. maybe them knowing that will bring them a tiny bit of comfort. also, for the friends and family’s sake, i want to correct any false facts. just so you can progress with as much truth as you can. eric’s hair has looked the same for six years. his day trip to mexico was planned two weeks before the accident. as far as i know the car was not washed and never left the driveway. finally eric did not replace the bumber. i’m only passing this on so you guys stay focused on true facts.please believe i am sincere.

Janis - Please stop commenting. We, the friends and family of Liberty, are all greiving immensely in a way that is beyond explanation. Defending, excusing and explaining these murderers is under no circumstances all right on here. We don’t care what their friends have to say about them. That isn’t what this website is for. If you want to help them, contact their lawyer to testify on their behalf at the trial or sentencing hearing, but under no circumstances try to defend them on here. I can say with almost 100% certainty that all any of us care about is seeing these people be fairly and justly treated by the law for what they did. You can defend them all you want, but they knowingly left the scene of a crime where someone was, at the least, extremely hurt, which is a very serious crime. Please stop commenting on here.

Janis,
You are absolutely wrong and have no idea on the workings of this case. Try doing your homework first before posting your reactionary views on something you don’t know anything about. “As far as you know” is exactly right, and you apparently know very little of what is really going on.

@Janis - Thank you for your candor. You offered information that was not given by those who had harshly commented before. I appreciate that and believe your sincerity.
@Deborah - My wife and I grieve as well, my wife’s best friend is Liberty’s Sister in Law. Please do not speak for all those who view/contribute to this site. Janis’ first line said she defends nothing.
Ultimately all the facts should come out in the trial.

Dear Ashu,
I wanted to point some things out before you go defending Janis. As a co-moderator of this site, I have been able to see not only all the wonderful posts by Liberty’s family and friends, but I have also had the opportunity to see the callousness of some individuals who have come on this site to push their own self-interested inhumane agenda by posting extremely disrespectful and abhorrent posts. Janis is someone who has shown complete disrespect to the friends and family of Liberty; Janis was one of the people who sent multiple harassing and disrespectful comments on this website that I was referring to in my initial post.
From now on, Janis is banned from all further use of this website. We are not here to debate, entertain, or interact with people like Janis who have said nonsensical things such as: “i feel this web page is not right and disrespectful and affending toward some ppl such as myself” (Janis, July 11th). There are more things she has said, but from now on I am not going waste anymore energy and frustration on people like her. As a co-moderator of this website, I will no longer allow nonsensical and antagonistic posts by her, or anyone else for the matter who comes on here to disrupt our effort to attain justice for Liberty.
This website was set up initially to catch Liberty’s killer and has subsequently shifted focus to provide an avenue where Liberty’s friends, family, and supporters can come together to talk about their memories of Liberty but also to get updates on the prosecution of Liberty’s alleged murderer. However, on behalf of the moderators, we will not entertain callous people who want to shift focus away from obtaining justice for Liberty or those who wish to show disrespect to Liberty’s memory.
As far as I am concerned, she can start her own website and stay off ours. There are things in this case that cannot be fully discussed in a forum such as this, but needless to say, she has no idea about what is going on and is attempting to mislead everyone in a plea to absolve Aguirre, and/or the passengers, from any wrongdoing and accountability in Liberty’s violent death and the subsequent prolonging of pain by not coming forward immediately after the crime.
I hope this provides some more context as to why Deborah was rightly upset with Janis’ continued disrespect and lack of knowledge of any of the workings of Liberty’s case. I do not wish to debate this any further in this forum, however, if you want to call or email me, please feel free to do so. Thanks.

Janis,
The police have told us what we know. The police have no reason to lie us. Therefore, we believe them.
